DataMaster® Privacy Policy

Applies to: DataMasterUSA.com and DataMaster® software operated by Market Data Service, LLC (“DataMaster,” “we,” “us,” or “our”).
Who this policy is for
Our Services are intended for adult professionals in the United States using DataMaster for real-estate business purposes. We do not knowingly collect personal information (“PI”) from children under 18. If you believe a minor has provided PI, contact us and we will delete it.
Scope
This Privacy Policy explains how we collect, use, disclose, and protect information when you:

visit our websites, applications, and portals (the “Services”);

communicate with us (e.g., email, SMS/MMS, phone, chat, webinars, events);

participate in our A2P (application-to-person) messaging programs over 10DLC long codes or toll-free numbers.
This policy does not cover third-party sites or services that link to or integrate with our Services. Their privacy practices are governed by their own policies.
Notice at Collection (California)
We collect the following categories of personal information from you and from your organization, service providers, and your devices:

Identifiers (name, business title, email, phone number, postal address, account IDs).

Commercial & billing information (subscriptions, purchases, payment method tokenized by our PCI-compliant processor).

Internet / device data (IP address, cookies, logs, app diagnostics, pages viewed, referring/exit URLs).

Geolocation data (approximate location from IP; optional precise location if you enable it).

Professional information (brokerage/firm, MLS affiliation).

Communications & content (support requests, survey responses, A2P message content you send to us).
Why we collect it: to deliver and secure the Services, authenticate users, process transactions, provide support, improve and develop features, comply with law/carrier rules, and market our own Services (you can opt out anytime).
Retention: We retain PI for as long as needed for the purposes above. Typical periods: account data for the life of the account plus up to 3 years; invoices/tax records 7 years; server logs up to 12 months; SMS consent records and opt-out logs at least 4 years to comply with communications laws and to defend against claims.
Sale/Share: We do not sell personal information and do not share it for cross-context behavioral advertising as those terms are defined under California law. If our practices change, we will update this policy and provide required choices.

Approximate location (from IP). If you enable precise location in your device/browser, we may use it to improve features (you can turn this off).

Your employer/organization (for seat management and provisioning).

Payment processors, communications vendors, analytics providers, and anti-abuse/security vendors.
How we use information
We use personal information to:

Provide the Services (create accounts, authenticate users, import authorized data, fulfill requests).

Communicate (service and transactional messages, product updates, security alerts, and—if you opt in—marketing by email/SMS/phone).

Operate, secure, and improve the Services (monitor performance, fix bugs, analyze usage, develop new features).

Comply with law and carrier rules (maintain records of consent and opt-outs; honor STOP/HELP).

Protect rights, safety, and integrity (fraud prevention, abuse detection, enforcing terms).

Aggregated/de-identified uses (statistics, trends). We do not attempt to re-identify de-identified data.
A2P/10DLC Text Messaging Privacy & Consent
We run A2P messaging programs over 10DLC/toll-free to deliver service notices, training/event reminders, and (with your consent) marketing.

Opt-in required. You will only receive marketing texts if you opt in (e.g., web form checkbox, text keyword, written consent, or recorded verbal consent captured by us or our provider).

Message frequency: varies by program.

No purchase condition: Consent to receive texts is not a condition of purchase.

Message & data rates may apply.

What we log: phone number, opt-in/opt-out status and timestamps, message content you send to us, delivery receipts, and limited device/carrier metadata.

Carriers: Wireless carriers are not liable for delayed or undelivered messages.

Recordkeeping: We keep consent and opt-out records for at least 4 years.
If your organization provisions your number on your behalf, we rely on your organization to ensure appropriate consent for its users.
Email communications

Transactional emails (e.g., receipts, service alerts) are part of the Services.

Marketing emails are sent only where permitted; you can unsubscribe at any time via the link in each message.

We follow CAN-SPAM requirements (accurate sender info, subject lines, physical address, and opt-out controls).
Cookies and similar technologies
We use necessary cookies for login and security, and optional cookies for analytics and first-party marketing. You can control cookies in your browser. If you block cookies, some features may not work.
Do Not Track / GPC: We currently do not respond to browser DNT signals, but we honor Global Privacy Control (GPC) for state “sale/share” opt-out where applicable.
How we disclose information
We disclose personal information to:

Service providers under contract (hosting, analytics, communications/A2P vendors, payment processing, customer support, security).

Your organization (admins may see user/account data and activity relevant to the account).

Integration partners you authorize (e.g., MLS or form software you connect).
-
Legal and safety (to comply with law, enforce terms, or protect rights/safety).

Business transfers (merger, acquisition, or asset sale; we will provide notice and your choices as required).
We do not sell PI and do not share it for cross-context behavioral advertising.
Data security
We use administrative, technical, and physical safeguards aligned with industry practices (encryption in transit, access controls, least-privilege, monitoring). No system is 100% secure; if we learn of a breach, we will notify affected individuals as required by law and take steps to mitigate harm.
Data retention
We retain information only as long as necessary for the purposes described above, to comply with legal, tax, and audit obligations, and to maintain required communications records (see “Notice at Collection”).
Your privacy choices & state rights
Depending on where you live (e.g., CA, CO, CT, UT, VA), you may have rights to:

Access/Know the categories and specific pieces of PI we collected about you.

Delete PI, subject to legal exceptions.

Correct inaccuracies.

Opt out of targeted advertising, sale of PI, or certain profiling (we do not sell or share PI; we use first-party analytics/marketing).

Limit use of sensitive PI (we do not intentionally collect sensitive PI).
How to exercise your rights:

If we deny your request, you may appeal by replying to our decision or emailing privacy@DataMasterUSA.com. If you remain unsatisfied, you may contact your state attorney general.

International visitors
Our Services are designed for U.S. use and hosted in the United States. If you access the Services from outside the U.S., you understand your information will be processed in the U.S., where laws may differ from those where you live.
Third-party links and integrations
Our Services may link to or integrate with third-party sites and tools. We are not responsible for their practices. Review their privacy policies before providing information.
Changes to this policy
We may update this Privacy Policy from time to time. The “Effective Date” above reflects the latest version. Material changes will be posted on this page and, where appropriate, notified to you through the Services.
